Waiver of Liability and Consent for Use of Image

Event Participation Waiver

In consideration of being allowed to participate in Next Race, I, the undersigned participant, acknowledge and agree to the following:

Assumption of Risk

I understand that participation in the Event involves inherent risks, including but not limited to injury, illness, or death. I voluntarily assume all such risks and hazards associated with my participation.

Release of Liability

To the fullest extent permitted by law, I release, discharge, and hold harmless Sports Racing UP!, its officers, directors, employees, volunteers, agents, and representatives (collectively, the “Released Parties”) from any and all claims, demands, actions, causes of action, and liabilities of any kind, whether known or unknown, arising out of or in any way connected with my participation in the Event.

Medical Treatment

I consent to receive medical treatment deemed necessary by the Event organizers in the event of an emergency.

Fitness to Participate

I represent and warrant that I am physically fit and sufficiently trained to participate in the Event and have not been advised otherwise by a qualified medical professional.

Governing Law

This waiver shall be governed by and construed in accordance with the laws of Texas, USA, without regard to its conflict of laws principles.

Consent to Use of Image

I grant Sports Racing UP LLC and its affiliates the unrestricted right to use, reproduce, and distribute my image, likeness, and voice in any media or promotional materials related to the Event. This includes, but is not limited to, photographs, video recordings, and audio recordings.
I acknowledge that I will not receive any compensation for the use of my image or likeness.

Acknowledgment

I have read this Waiver of Liability and Consent for Use of Image, understand its contents, and agree to be bound by its terms. By signing below, I acknowledge that I am voluntarily participating in the Event and consent to the use of my image as described.

Refund Policy, Kit Pickup, Bib Number Replacement, and Donation of Unclaimed Items

1. No Refunds

• All registrations for the race (5K or 10K) are strictly non-refundable, without exception.

• Once payment has been completed, no refunds will be issued for personal, medical, scheduling, or any other reasons.

• Registration funds are used immediately for event operations, making refunds impossible.

2. No Registration Transfers

• Transfers of registration to another participant or name changes are not allowed unless explicitly authorized by the event organizers.

3. Post-Event Kit Pickup

• If a participant is unable to attend on race day, they may request their race kit (shirt and medal) up to one week after the event date.

• Post-event kit pickup is subject to:

  • Proof of registration

  • Availability of shirt sizes

  • Pickup at the time and location designated by the organizers

• After one week from the event date, participants forfeit the right to claim their kit, with no refund or compensation.

4. No-Show Policy

• Participants who do not show up on race day are not eligible for a refund.

• They may only collect their kit within the one-week post-event window described above.

5. Bib Number Replacement Fee

• If a participant forgets, misplaces, or damages their bib number, a replacement may be issued.

• The replacement fee is $10 USD, payable at the time of the request.

• Replacement bibs are subject to on-site availability.

6. Donation of Unclaimed Shirts and Medals

• All shirts and medals unclaimed one week after the event will be donated to individuals in need or low-income communities.

• Once donated, these items cannot be reclaimed.

7. Event Rescheduling or Force Majeure

• If the event is rescheduled due to circumstances beyond the organizers’ control (extreme weather, safety concerns, official orders), registrations will automatically transfer to the new date.

• No refunds will be provided under any circumstance.
